Employers did not Fairly Consider Singapore Locals for Their Job Opening
In its effort to protect the local labour force, the EP applications over the years have been subject to more stringent approval process.
Companies are encouraged to genuinely consider locals before hiring foreigners. To ensure this, employers are required to advertise the vacant role for on the National Jobs Bank for at least 28 days before the EP application. Find out if your company is exempt from this requirement.
If the MOM suspects that a company has unfair hiring practices, they may curtail their work pass privileges and may even place it on a blacklist until improvements are seen.
There may have been Issues with the Company Profile
MOM may state reasons for rejection that are specific to the Company. For example, your company’s business activities or industry may be considered irrelevant to Singapore’s economy, your company may have insufficient Singaporean core.
It would be beneficial to provide detailed information relating to the company’s business activities, manpower projection and a justification for employing the candidate such as special skillset that cannot be found locally.
The Candidate does not Match the Job Profile
An EP may also be rejected because the proposed salary, candidate’s educational qualification, or relevant work experience does not commensurate with the job position applied for.
It is not enough to give the candidate the base salary required for an EP. From our experience, candidates with higher salary have better chance of having their application approved, provided the candidate’s educational qualification and relevant work experience justifies it. That said, having salary that are unrealistically higher than the market rate could also lead for rejections
Candidates who are changing industries or job roles may also face difficulty in getting their EP approved unless they can demonstrate a transferrable skillset.
So What Happens after a Rejection?
You can submit an appeal by addressing the issues or reasons stated on the Rejection letter. Such appeal must be submitted within three months of date of the rejection letter. Otherwise, a fresh application will need to be submitted.
All appeals are subject to review by the MOM Officer. Additional information may be requested. The outcome of the appeal takes approximately 3-5 weeks.
How to Ensure an Appeal is Accepted?
Write a compelling appeal letter
A detailed description of your Company’s business, its marketing strategy and 3 to 5 year financial and manpower projection will help the MOM Officer to better understand your business. In addition, the company must also justify why the EP applicant is the best candidate for the job position e.g. what special skillset that he/she has.
Ensure you have an updated LinkedIn Profile/CV/Cover Letter
Submit a well-written and up-to-date resume along with all relevant educational credentials, certifications and awards. Testimonials from professional associations, business partners, and customers will further enhance your profile required for the MOM Officer’s re-evaluation.
